GO AFTER YOU DREAMS CONTEST RULES
CONTEST & PRIZE SPONSOR: AVA MD
ELIGIBILITY REQUIREMENTS:
To be eligible for entry into the AVA MD Go After Your Dreams contest, individuals must:
• be legal residents of the United States;
• be eighteen (18) years of age or older at the time of entry;
To be eligible for the AVA MD Go After Your Dreams grand prize of a Dream Makeover, individuals must:
• be a medically appropriate candidate and not have undergone significant prior cosmetic surgeries, as determined by the AVA MD judging panel; all decisions of this panel are final.
The following individuals are not eligible to participate in or receive prizes from the AVA MD Go After Your Dreams contest:
• employees, officers, directors, immediate family members (spouse, parent, child, sibling or their respective spouses, regardless of where they reside, or member of the same household, whether or not related) of AVA MD;
• employees, agents, officers, directors, immediate family members (spouse, parent, child, sibling or their respective spouses, regardless of where they reside, or member of the same household, whether or not related) of any and all other companies associated with the AVA MD Go After Your Dreams contest.
There is no entry fee. Individuals who meet the requirements described above are “Eligible Entrants.” The AVA MD Go After Your Dreams contest is subject to all applicable federal, state and local laws, rules and regulations. Void outside the United States and where prohibited or restricted by law, rule or regulation.
HOW TO ENTER: The AVA MD Go After Your Dreams contest “Entry Period” begins September 1, 2011, 12:01 AM PDT and ends October 31, 2011, 11:59 PM PDT. To participate, Eligible Entrants must submit 250 words or less describing how a recent cosmetic treatment positively impacted their life and a before and after photo. Entrants can only submit one submission per person to dr_ava@avamd.com with their contest entry during the Entry Period.
The Contest Sponsor is not responsible for entries that are not received for any reason, or for entries that are received, but are not decipherable for any reason. The Contest Sponsors will automatically disqualify: 1) any submission from a non-eligible individual; 2) an incomplete or illegible entry; and 3) any entries received in excess of the entry limit described above.
WINNER DETERMINATION: At the end of the Entry Period after October 31, 2011, 11:59 PM PDT, a Grand Prize winner will be selected from all eligible entries by way of random drawing. Ten (10) other winners will be selected by a panel of judges from the AVA MD team. Eligible entries are those written and photo submissions sent to dr_ava@avamd.com that abide by the contest and eligibility requirements. All contest winners shall be required to sign an Affidavit of Eligibility within ten (10) days of prize notification, described elsewhere herein. Contest winners who do not complete the required form within ten (10) days of notification shall be disqualified and the panel of judges may then select a runner-up.
PRIZES:
A. ONE (1) GRAND PRIZE: All qualified entries will be entered into a random drawing to win a Dream Makeover from the AVA MD team. The Dream Makeover will include a consultation of the winner’s cosmetic needs and a customized course of treatments as prescribed by AVA MD. Travel and lodging expenses ARE NOT included.
B. ONE (1) FIRST PRIZE: Complete skin care regimen from AVA MD (approximate $350 value)
ONE (1) SECOND PRIZE: Ageless Collection Sun Security SPF 25 Sun Screen Lotion + NIA24 Physical Cleansing Scrub (approximate $80 value)
C. ONE (1) THIRD PRIZE: Radical Departure Orange Calendula Wash + Anti-Oxidant Mist ($68 value)

Each Winner is fully responsible for any and all applicable federal, state and local taxes and fees/charges (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided are the sole responsibility of each Winner. Each Winner must agree to comply with all applicable laws and regulations in connection with the Prize. Released Parties (defined below) will not be responsible for acts of third parties, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of awarding prizes. All Prizes are non-transferable and non-assignable, with no cash redemptions.
NOTIFICATION: Between November 1 – 30, 2011, the Contest Sponsor will send an e-mail (“Prize Notification”) to the eleven (11) AVA MD Go After Your Dreams contest winners. All AVA MD Go After Your Dreams contest winners shall, within three full (3) calendar days of issuance of Prize Notification, provide the Contest Sponsor with the following information: (1) all eligibility information, i.e., proof of age, and U.S. residency; (2) name; and (3) winner’s e-mail, mailing addresses and telephone number. In the event the Prize Notification is returned as undeliverable, or the Winner is otherwise unreachable for any reason, the Contest Sponsor may select an alternate winner who will be notified by e-mail to provide the Sponsor with the following information: (1) all eligibility information, i.e., proof of age, and U.S. residency; (2) name; and (3) winner’s e-mail, mailing addresses and telephone number. In the event any alternate Winner fails to respond to any such Prize Notification within three (3) calendar days of the date of issuance, the alternate will be disqualified, and the Prize will be forfeited, at the Contest Sponsor’s sole discretion. Failure to timely submit required documentation as described herein will result in disqualification and forfeiture of Prizes.
WAIVER OF LIABILITY/PUBLICITY RELEASE: Participation in the AVA MD Go After Your Dreams contest constitutes the Entrant’s full and unconditional agreement to and acceptance of the contest rules. By participating in the contest, the Entrant represents and warrants that he/she has read and understood, and agrees to be bound by these rules. By participating in the contest, Entrants waive any and all claims against AVA MD, and any and all other firms associated with the AVA MD Go After Your Dreams contest, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the AVA MD Go After Your Dreams contest or from the receipt or use of any Prize or activity related to the receipt or use of any Prize. By participating in this AVA MD Go After Your Dreams contest, each entrant gives his or her express permission to be contacted by the Contest Sponsor, the Prize Sponsor and/or their respective designees by telephone, e-mail and/or postal mail for AVA MD Go After Your Dreams contest purposes only. Each Winner, by acceptance of Prize, grants to the Contest Sponsor, the Prize Sponsor, and each of their respective designees the right to publicize such Winner’s name, city and state of residence, photographs, voice, statements and/or other likeness and prize description in any media now known or hereafter devised, throughout the world, in perpetuity, without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: By participating in the AVA MD Go After Your Dreams contest and submitting any entry e-mails, each entrant agrees that the Released Parties are not responsible for stolen, late, incomplete, inaccurate, misdirected, lost, damaged, delayed, postage-due or garbled entries, email or mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the AVA MD Go After Your Dreams contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the AVA MD Go After Your Dreams contest, the processing of entries, or the announcement of the Prize or in any AVA MD Go After Your Dreams contest -related materials. For details regarding collection of information from Eligible Entrants, please consult the privacy policy available on the Contest Sponsor’s web site. Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the AVA MD Go After Your Dreams contest. Released Parties are not responsible for injury or damage to participants or to any other person’s computer related to or resulting from participating in this AVA MD Go After Your Dreams contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the AVA MD Go After Your Dreams contest or website or attempt to undermine the legitimate operation of the AVA MD Go After Your Dreams contest by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Contest Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by Contest Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this AVA MD Go After Your Dreams contest is unlawful and subject to legal action by the Contest Sponsor, the Prize Sponsor or their respective agents. Sponsors shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the AVA MD Go After Your Dreams contest, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. Any Sponsor’s or Prize Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All disputes will be resolved under applicable U.S. laws in the State of California.This Agreement will be governed by the laws of the State of California. Any court of competent jurisdiction sitting within Los Angeles, California will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Agreement. Entrants hereby waive any argument that any such court does not have jurisdiction or improper venue regarding any and all disputes arising out of the AVA MD Go After Your Dreams contest, including the award of prizes. The Contest and Prize Sponsors shall be entitled to recover their court costs and reasonable attorneys’ fees and expenses incurred in successfully proving any breach of any term of this Agreement.
The Contest Sponsor reserve the right, in their sole discretion, to amend, modify, cancel or suspend the AVA MD Go After Your Dreams contest (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the AVA MD Go After Your Dreams contest (or any portion thereof). In the event of cancellation, the Contest Sponsor may elect to identify winners and award the prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
Entries generated by a script, macro or other mechanical or automated means will be disqualified. All online entries must be submitted from a valid e-mail account for the entrant. In case of multiple entries received from an e-mail account, only the first entry received from such e-mail account will be considered. In the event of dispute as to the identity or eligibility of any winner based on an e-mail account, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail account at the time of entry provided he/she is eligible according to these Official Rules.
